Welcome to Malvern. “We”, “us” and “our” mean Malvern. We operate this store and its related content, features, products and services (the “Services”). BigCommerce provides the store platform and Stripe processes payments. Purchases are made from Malvern.
These Terms of Service (“Terms”), together with the policies linked here, describe the rules for using the Services. By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. Nothing in these Terms limits a consumer right that cannot legally be limited.
1. Access and accounts
You must be old enough to make a purchase where you live, or have permission from a parent or guardian. You may need to provide an email address and billing, payment and shipping details. Keep this information accurate and current, and only provide information you are allowed to share. If you create an account, keep its login details secure. You are responsible for activity on your account and may not transfer or sell it.
2. Products
We aim to describe and show products clearly. Appearance can vary between screens and their settings. Product information, availability and prices may change for future orders. The product information and terms shown when you place an order apply to that order. Later changes to these Terms do not change existing orders. Rights that cannot legally be limited still apply.
3. Orders
We accept an order when we send you an order confirmation, subject to applicable law. Check your order before submitting it. See our Cancellation Policy. If we change, decline or cancel an order, we will try to contact you using the details given at checkout. Returns and refunds are explained in our Returns and Refunds Policy. Purchases must be for personal or household use, not commercial resale.
4. Prices and billing
The amount charged is the amount shown when you place your order and in its confirmation, subject to correction of an error where allowed by law. Shipping, taxes, customs duties and import charges are included only where the order says they are. You agree to provide accurate purchase and payment details and to pay the displayed charges. You must be authorised to use the payment method provided.
5. Shipping and delivery
Delivery information and the estimate shown when you order apply to that order. Carriers, customs or events outside our control may cause delays. If we learn that we cannot meet the promised delivery time, we will contact you and give you the choice to wait or cancel for a prompt full refund. Our Shipping Policy explains delivery and tracking.
6. Intellectual property
The Services, including Malvern's name, text, images, graphics, product information, videos, audio and site design, belong to us or our licensors and are protected by law. You may use them for personal, non-commercial shopping. You may not copy, distribute, modify, publish or use them commercially without permission. Third-party names and marks belong to their owners.
7. Optional third-party tools
The Services may link to optional tools provided by other companies. Their own terms and privacy notices apply. We do not control every optional tool. New store features will be covered by these Terms unless separate terms say otherwise.

Our Services may link to sites or content operated by others. We do not control their content. Review their terms and policies before using them or buying from them.
9. Store and payment providers
BigCommerce supplies the store platform and Stripe processes payments for Malvern. Your sale is with Malvern. Our Privacy Policy describes how we collect, use and share personal information in connection with the Services.
11. Feedback
If you send us ideas, suggestions, reviews or other feedback, you allow us to use and share it to operate, improve and promote the Services. You confirm that you have the rights needed to submit it and that it is lawful. We may remove feedback that violates these Terms or another person's rights. Nothing here takes away any right that applicable law gives you.
12. Errors and omissions
Product descriptions, prices, shipping charges, delivery estimates or availability may contain mistakes. We may correct information for future orders. If an error affects your order, we will contact you and handle it in line with applicable law.
13. Prohibited uses
Use the Services lawfully. Do not infringe another person's rights, threaten others, submit false information, impersonate someone, send spam or harmful code, collect another person's personal information without permission, or interfere with the Services' security or operation. We may suspend access for a breach where the law allows.
14. Ending access
We may end your access to the Services if you breach these Terms or where otherwise allowed by law. Amounts already due remain payable. Terms that by their nature continue after access ends remain in effect.
15. Warranties and consumer rights
We do not promise that access to the Services will always be uninterrupted or error-free. Products and services remain subject to any consumer guarantees, warranties or other rights required by law. Nothing in these Terms excludes a right that cannot legally be excluded.
16. Disputes
If you have a concern, email support@malverncomfort.com with a description of the issue and the outcome you seek. We will try to resolve it. Any formal dispute process and governing law are subject to mandatory consumer rights where you live. Nothing here prevents you from raising a concern with your bank, payment provider or a relevant consumer agency.
17. Severability
If part of these Terms cannot be enforced, it will apply only to the extent allowed by law, and the remaining Terms will continue.
18. Waiver and entire agreement
If we do not enforce a provision once, we do not give up the right to enforce it later. These Terms and the policies they link describe the agreement about use of the Services, except where other terms apply or the law requires otherwise.
19. Assignment
You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours where allowed by law and with any notice required by law.
20. Changes to these Terms
The current Terms are available at /terms-of-service/. We may update them by posting a new version and giving any notice required by law. The updated Terms apply from the stated date where the law permits. Changes do not alter terms that applied to an order already placed.
